Working and Skilled Visas

Business Innovation & Investment (Provisional) visa(subclass 188)

There are five streams under this visa program.

Business Innovation Stream

Under this stream, you can establish, develop and manage a new or existing business in Australia. Applicant must be nominated by a state or territory government. 

Investor Stream

Under this stream, investment of at least AUD 1.5 million is required .Applicant must be nominated by Australian state or territory government.

Significant Investor Stream

Under this stream, investment of at least AUD 5 million is required.

Premium Investor Stream

Under this Stream, an investment of at least AUD15 million is required

Entrepreneur Stream

Under this stream, a funding agreement  is required from a third party for at least AUD 200,000 to undertake a complying entrepreneur activity that is proposed to lead either the commercialisation of a product  or service in Australia or the development of a business in Australia.

Business Innovation&Investment (Permanent) visa (subclass 888)

This is the second stage of Business Innovation and Investment (Provisional) visa.You are eligible to apply for this visa only  if you have fulfilled the requirements of first stage subclass 188.You are not required to get a new EOI or an invitation from state or territory to apply. However , you need evidence of your nomination. 

Business Talent (permanent) Visa (subclass 132)

This visa will allow you to establish a new business or you can develop an existing business in Australia. You must be nominated by a state or Territory government or invited to apply for this visa.There are two streams:

Significant Business History stream

You must have net business and personal assets of at least AUD 1.5 million. Your annual business turnover must be AUD 3 million.

Venture Capital Entrepreneur Stream

 You must have at least AUD 1 million in venture capital funding to start the commercialisation and to develop high value business ideas in Australia.

 Business Visa Requirements

 - Applied for an expression of interest ( EOI ) and received an invitation to apply.

 - Nominated by state/ territory government or Austrade.

 - Invited to apply.

 - Sufficient funds to work and settle in Australia.

 - You must meet certain health requirements.

 - you must meet certain character requirements.

Employer Nomination Scheme visa (subclass 186)

This is a permanent visa for workers , who want to work and live in Australia on a permanent basis and are nominated by an approved Australian employer in a skilled occupation.There are following streams under this visa category:

Temporary Residence Transition stream ( TRT )

You can apply under this stream if you are a 457 visa holder.  You have worked for your employer for at least two years and your employer want you to offer a permanent position in the same occupation.

Direct Entry stream ( DE )

You can apply under this stream if you have three years of relevant work experience in a nominated occupation.You must have the required qualifications and skill level as well as positive skills assessment.

Regional Sponsored Migration Scheme visa (subclass 187)

This is a permanent visa for skilled workers designed to help regional employers to fill positions that they are unable to fill from local labour market. There are two streams under this visa category:

Temporary Residence Transition stream

You can apply under this stream if you are a 457 visa holder.  You have worked for your employer for at least two years and your employer want you to offer a permanent position in the same occupation in a regional area.

Direct Entry stream ( DE )

If you have no experience in the Australian labour market but you have the required qualifications and skill level then you can apply under this stream.

Skilled Regional (Provisional) visa (subclass 489)

This visa will allow skilled workers and  their family members to live and work in specified regional or low population metropolitan areas of Australia for a period of four years.

There are three following pathways

Extended Stay Pathway

You might be eligible to apply for the Extended Stay Pathway if you are the skilled worker who has held one of the following visas and complied with all visa conditions, for at least two years before applying for this visa:

  • Skilled-Regional Sponsored visa (subclass 475)

  • Skilled-Regional Sponsored visa (subclass 487)

  • Skilled-​Independent Regional visa (subclass 495)

  • Skilled-Designated Area Sponsored Provisional visa (subclass 496)

There are exemptions to the age and English language requirement; however, these are on a case by case basis. There are also waivers for health requirements in some circumstances.

Invited Pathway

This pathway is for the applicants, who do not meet the criteria for the extended stay pathway. To apply for this visa you should be

  • Nominated by an Australian State or Territory government

  • Nominated for an occupation that is on the relevant skilled occupation list

  • Achieve suitable skills assessment for that occupation

  • Be under the age of 50

  • Achieved the score specified in your letter of invitation based on the points test

  • Have competent English language skills

Subsequent Entry Pathway

The subsequent entry pathway is for applicants who are a member of the family unit of someone who already holds a Skilled Regional (Provisional) visa (subclass 489) or a subclass 475, 487, 495 or 496 visa.

 

Temporary Graduate visa (subclass 485)

This visa is for an international student who recently graduated from an Australian educational institution, it will let you live, study and work in Australia temporarily after you have finished your studies 

You can apply under the following streams:

Graduate Work Stream  

Under this stream length of stay is for 18 months 

Post Study Work Stream

Under past work stream length of stay is from two to four years

Work Visa Requirements:

- You must have required level of English Language(unless exempt)
- You must have relevant qualifications or work experience

- You must hold relevant registration& licensing

- You are less than 50 years old

- You must meet certain health requirements.

 - you must meet certain character requirements.

Temporary skill shortage visa (subclass 482)

This visa is also known as TSS visa.TSS visa holders can work in Australia in their nominated occupation for their approved sponsor under one of  the following three streams:

The Short-Term stream

You can apply under this stream if your employer wishes to sponsor you as an overseas skilled worker on a temporary basis only in occupations listed on the Short-term Skilled Occupation list (STSOL) for a TSS visa. This visa can be used to fill positions for a maximum of two years or four years if an International Trade Obligation (ITO) applies.

The Medium-Term stream

This stream is available to you if your employer wishes to sponsor you as an overseas skilled worker for periods of up to four years in occupations listed on the Medium and Long-term Strategic Skills List (MLTSSL) or the Regional Occupation List (ROL) for a TSS visa.

The Labour Agreement stream

This stream is available if your employer wishes to sponsor you as an overseas worker and has entered into a labour agreement with the Department.

TSS visa Requirements

  • You must be nominated for a position by an approved sponsor and that nomination has been approved 

  • You must meet any required skills and qualifications requirements including  any skills assessments required

  •  You must meet English language requirements

  • if in Australia, hold a substantive visa, a subclass 010 (Bridging A) visa, a subclass 020 (Bridging B) visa or a Subclass 030 (Bridging C) visa

  • have substantially complied with any conditions that apply or applied to your last visa

  • You  must meet health and character requirements

  •  You must meet the requirements of the stream in which you apply.

Additional eligibility for each stream

Short-term stream

To get a visa under this stream  in addition to the above general requirements, you need to fulfill the following requirements:

  • have worked in your nominated occupation, or a related field for at least two years

  • are a genuine applicant for entry and stay as a short term visa holder (known as a 'Genuine Temporary Entrant' (GTE))

  • will be working directly for your sponsor or for an associated entity of your sponsor, unless the nominated occupation is exempt from this requirement 

 

Medium-term stream

To get a visa under this stream  in addition to the above general requirements, you need to fulfill the following requirements:

  • have worked in your nominated occupation, or a related field for at least two years

  • will be working directly for your sponsor or for an associated entity of your sponsor, unless the nominated occupation is exempt from this requirement 

Labour agreement stream

To get a visa under this stream  in addition to the above general requirements, you need to fulfill the following requirements:

  • are nominated in an occupation included in a labour agreement your employer has entered into with the Department

  • have worked in your nominated occupation, or a related field, for at least two years (unless this is not required under the labour agreement).

 

​Skilled Independent visa (subclass 189) (Points-tested) 

This visa is for points tested skilled workers who are not sponsored by an employer or family member or territory government. It will allow you to live and work in Australia as a permanent resident. For this visa you need to submit an expression of interest ( EOI ). You might be eligible to apply for this visa if invited.

Independent skilled visa Requirements

  • You have nominated an occupation that is on the relevant skilled occupation list

  • You have obtained a suitable skills assessment for your nominated occupation

  • you meet the points test pass mark of 65 points

  • You must be under 45 years of age at the time of invitation

  • you must have at least Competent English

Skilled Nominated visa (subclass 190)

This visa  will allow skilled workers who are nominated by an Australian state or territory government  to live and work in Australia as a permanent resident.

Skilled Nominated visa Requirements

In order to apply for this visa you must:

  • have a nominated occupation that is on the relevant skills occupation list

  • have a suitable skills assessment for that occupation

  • meet the points test pass mark of 65 points

  • be nominated by a state or territory government agency

  • be under 45 years of age at the time of invitation

  • have Competent English

  • be invited to apply.
